Question about Leagalization

When it comes to legalization in Montenegro, it is important to know several key facts.

First, legalization refers to buildings that were built without a building permit or that are not fully in accordance with the planning documentation.

For the legalization of buildings in Montenegro, the Law on Spatial Planning and Construction of Buildings, which began to be applied for legalization issues in October 2017, is applied. This law was passed in order to enable the procedure of legalization of illegally built buildings, as well as illegal parts of buildings that were built according to the Law, but exceed the parameters of Urbanistic-Technical (UT) conditions due to their square footage or positioning on the plot. Also, it is important to note that during the past years, amendments and additions to this law were made, and the procedure has been supplemented.

The process of legalization includes the submission of a request with the appropriate documentation attached, which is prepared at the request of the owner by a professional team composed of surveyors, architects, statics, auditors, sometimes appraisers and lawyers, all depending on the legal and technical condition of the object. This entails the payment of certain fees and charges on the owner’s account.

In order to fully complete the process of legalization of the building, or the illegal part of the building, it is necessary to meet certain conditions, including compliance with regulations on construction and urban planning regulations. This process may take some time, but it will allow the owners to regularize the status of their property.

This means that the object becomes recognized by the state and that the owner acquires the right to use and dispose of it without restrictions.

By legalizing the building in Montenegro, the owners get legal security and legal status for their illegally built property. This means that the object becomes recognized by the state and that the owner acquires the right to use and dispose of it. Also, legalization allows the facility to be registered in the real estate cadastre, which provides additional legal protection. In addition, legalization can have other benefits such as access to water supply, sewage, electricity and other public services, as well as the possibility of obtaining a loan or selling a building with regular legal status.
